    Subject: Why the Jail Time?
    All, Does anyone have any additional information on this verdict? http://www.aopa.org/aircraft/articles/2008/080221pilot.html I'd like to know why they jailed the pilot. Was it: 1. Because he gave rides as a private pilot? (Should have been a commercial pilot.) 2. Flew aerobatics without parachutes and/or at low altitudes? 3. Flew down the river at 50', hitting power lines? 4. Simply because he was responsible for killing someone, as in negligent homicide? No conjecture please, just facts. (I'm hoping some of the Wisconsin locals might have seen this and know about it.)     here are a few pics of mine. I did the emt framework, and covered it with a truckers tarp. the nose is fiberglass that they cover motorhomes with. the tail wheel goes up a ramp, and the wing tips fit nicely into the nose of the trailer. Call me if you have any questions about hauling it. I've gone about 2500 miles so far, and had no issues.     jlfernan, There are not too many out there. But the list is great and you can get almost any question answered within a matter of hours (usually less than that) and nearly any of us will sent pictures of "how I did it" for specific questions. I have tried to document all of my building with pictures (like most of us have) but have not taken the time to put it all on a website...I would rather be building than typing. I think you are the one who recently purchased a Super Sport so when you run into a problem or question, it is very likely that a handful of us have had the same question and that it has been answered before on the list. The archives are sort of hit or miss on a search so if you don't find what you are looking for post the question and we will try to answer. I have attached a couple pics of my progress for some motivation for you. These are great little airplanes and the build, although completely different than building an RV, is every bit as satisfying (I've done both now).     The article doesn't state: 1. Whether he was charging folks for the rides. Commercial certificate is not required if he is not operating for compensation or hire. 2. Whether the resultant court action was in a municipal, state, or federal court, but the " negligent operation of a motor vehicle and disorderly conduct" charges are not something you will find in the FAR's. The term "motor vehicle" is usually used in municipal and state ordinances and laws, which in many states encompasses anything with an engine, electric or hydraulic motor, Careless and reckless operation of an aircraft is more like what would be in the FAR. 3. Whether any administrative action was taken against any Airman Certificate he held, which is usual for an FAA enforcement action, but not a municipal or state court.     John: Don't know much about enclosed trailers but hard trailer suspensions are an issue whether open or enclosed. Most boat-type trailers from which our home-made trailers are typically constructed, are designed to carry much more than your Fox weighs. As a result, every bounce will be transmitted directly to the cargo rather than "absorbed" by the suspension. Double axles help some. As you probably know, the stock, Kitfox single-leaf steel tailspring was notoriously prone to failure under the best of conditions. With the wings folded, the load on this spring increases dramatically.     Are we sure the prop on that machine was facing into the wind? Don't vane-less wind generators usually have the generator/gearbox nacelle on the up-wind side and the prop turning on the down wind side?     I got my spinner from this site: http://www.uhsspinners.com/index.html I have the F-model Powerfin prop on my Classic IV. The spinner fit nearly perfectly at the get-go. The only thing I added were holes in the plate to check the torque on the blades without having to remove it. -Margaret H. We have plenty of hydro-energy from the waterfalls. But as soon as you cross the border to Sweden and even much more when you come to Denmark, north Germany and The Netherlands, they are everywhere and I really mean: everywhere! Even in the final approach line of airfields. All those I have seen (the actual accident happened in Denmark) have the rotor facing the wind. They don't have a wind vane to turn them mechanically, instead they have a tiny one that activated a step motor to turn them. What was also strange in the video is that the rotor was turning very, very fast. Probably way above what it was designed for. Usually, once they have enough wind, they turn at a constant speed. If the wind increases, so does the pitch and the produce more electricity. But, from all my days of flying and sailing in those regions; they are either stopped, or moving at a constant speed. I even remember being in Scheveningen, in the Netherlands, harboring a storm in the harbour and looking at the wind turbine at the entrance of it. It turned quite slowly.     Subject: Mod 3 landing gear rebuild
    Kitfoxers, OK, I give up. I bought a damaged Mod 3. The landing gear was knocked out from under it while on a trailer by a car. Included in the purchase was a set of new landing gear struts. Wired to the struts are 2 tee pipes. They are 3" tall with a 3/4" cross piece welded on top. They are made from 3/8" dia. steel tubing. The top cross piece is 9/16" ID with a 5/32" ID at one end. As you probably know, the stock, Kitfox single-leaf steel tailspring was notoriously prone to failure under the best of conditions. With the wings folded, the load on this spring increases dramatically.     Actually what I was getting at was that the turbine reacted according to the laws governing a gyroscope - that is, a gyro will react 90 degrees to the force applied to it. The departing blade left an imbalance which tried to turn the turbine. The 90 degree rule dictated (in this case) that that action should express by nodding down and the blade whacked the pylon. This is something we get ground into us in gyro training. When you tilt the rotor back to flair to land, the gyro will tend to tip left or right, depending on the rotation. This is pronounced in larger gyros. Likewise (with mine), left stick would induce a forward pitch. You learn to deal with it. With the turbine in question, the force of the wind on the blades is negligible compared to the outward centrifugal forces from the rotation of the blades. There will have been very little coning effect due to the induced rigidity of the rotor disk. The first blade simply failed mechanically as will any blade if you spin it fast enough. From there, the dynamic imbalance created pure havoc in a very short period of time. The important lesson there is that all rotating parts should be in excellent balance. The weight of smashed bugs were enough to induce significant stick-shake on my gyro with a 25 foot rotor and it only spun at 350 rpm. The weight of a 1cm square of duct tape at the tip of a prop will induce a lot of vibration. Vibration robs performance, shortens engine and airframe life, and fatigues the pilot. I'm still in awe of the Carbon Cub, though. The UHS fiberglass spinners from ACS are "pretty good". I'm using the 10" on my 3-blade Warp. The only thing I recommend is that you do your own cut-outs, if you have any skill at all. (91.119a) It's also interesting that 91.119c specifically exempts staying 500' above "open water". Don't know if the river he was over was "open water". He certainly wasn't 500' over the power line "structure", if that's what you call it, though of course he didn't know it was there. Why am I interested? Because that kind of flying is what Kitfoxes do best. If it carries a presumption of negligence then it just got a lot more dangerous, (for the pilot.) "Her opinion was that he flew in violation of 91.119 of the US FAR 91.16, which is entitled Minimum Safe Altitudes that requires an altitude of 500 feet about the surface over congested areas. This would include that an aircraft should not be operated closer than 500 feet between a person, vessel, vehicle or structure. She further believes that his piloting was in violation of FAR 91.13 entitled Careless or Reckless Operation of an Aircraft. ASI Kruegers opinion was that Strub was negligent in the piloting of the airplane over the River flying at altitudes somewhere in the area of 50 feet above the water. ASI Krueger states that all pilots are required to fly at higher altitude so that if there is a problem with the aircraft, the pilot can attempt to safely land. The distances off the ground that Strub was piloting his plane would clearly not allow him to recover from any engine problem. 6. On August 2, 2005, Gregory Gorak, a pilot with 38 years of piloting experience, certified as a professional flight instructor holding several other professional certifications, stated to Inv. Gosh that he had an opportunity to read a copy of the accident investigation involving the crash. In his opinion, this was clear error on the part of the pilot in being careless and reckless in the operation of his aircraft since there would no time for any safe landing when you operate an aircraft between 30 to 40 feet above the water, other than possibly a seaplane. Gorak is aware of the regulations as to how many feet above water you must safely operate and that indicated that no prudent pilot would operate in such a manner as the defendant did.
