Mike, I can't speak for Minnesota law, but here in Kansas it means simply
if you let people use your property without charge, they can't hold you
liable if they twist their ankle or hit a deer while landing. And you don't
have to make the deer wear orange vests or carry blinking lights on their
antlers, just use reasonable care in keeping up any specially created
attractions. For instance, if a sink hole were to open up in the middle of
your runway, you would be responsible for marking the runway as
inactive. The non-commercial flying provision is added insurance to the
"any other activity" clause. If you have any doubts, find an AOPA
registered attorney and spend a few bucks having him decipher all the ins
and outs for you. Also have him examine any insurance policy you might
consider having for added protection. My friend Jim did that for his home
owners association and found that they were paying $1500 a year for a
retainer. There really was no insurance, just $1M worth of attorney fees to
fight any claim against them.
