Subject: | aerial photos legality issues- do not archive |
So this has nothing to do with Piets, but it is flying related.
I posted some pictures I took from my powered parachute of my town and surrounding
area. Someone from the local historical society (not for profit organization)
approached me about using my photos in a book they are putting together on
the history of the area.
I am concerned about the reg that says you can't make money with your aircraft
unless you are commercial, but I won't make any money, and it would be used by
a not for profit org.
Any ideas?

I post aerial photos on Facebook all the time. My wife has used
pictures on her real estate website, just be sure you aren't sited as
the contributor.

You're fine as long as you don't trade any money or valuables for them.
(don't even except gasoline) "Donated by" will suffice. Your local FSDO office
can give you the answer as well. It's not a big deal.
You cannot charge for the airplane, due to it being in the Experimental category.
You can charge for you personal services if you have a commercial rating.
Otherwise, consider it a donation. Then you are safe all the way around.

Thanks everyone. I didn't think it would be a problem if I REALLY didn't accept
money. I regularly give people free pictures of their homes...shoot, I am always
looking for an excuse to fly!
