Hello to all:
My name is Bob Atkinson, Lumberton, NJ and I have a question re: a
statement I read on the Serve e-m dated 1/23, posted by Ron Awad.
If I understand the statement a "builder of an aircraft (or his heirs,
estate etc) has a permanent liability to any/and all future owners or passengers
of said airplane", is this correct?
REASON FOR ASKING:
I am contemplating building an RV 7A.
However, in the event of my departure from planet earth, my would want to
dispose of the plane -- having no use for it herself.
I don't wish to place the burden of potential liability upon her and that is
what caught my attention when I read Ron Awad's e-m.
Any answers and or comments would be greatly appreciated and I want to thank
anyone who would take the time to respond.
P S I have been eavesdropping on the Serv em for about two years and I
really do enjoy hearing all of you talk about your experiences and adventures.

I think everyone was kept away from LKR last weekend due to the winds. So
what is plan B for next Sunday? I'll kick things off by suggesting
Stanton's, and perhaps dropping in at Phil's afterwards. Since I'm without
plane, my 2 cents is worth even less these days, so if you have a better
idea chime in. I'll be with Lima Lima.

The Experimental Aircraft Association has information on how to sell a
homebuilt aircraft but there is nothing that prevents any future
owner/pilot/passenger from persuing the builder should something go wrong.
Suggest you contact the EAA for their input.

However, to be totally sure of no future liability do not build the
airplane.

Bob Atkinson,
You could buy one already built! Then the builders Liability would pass thru your
heirs.
Just an Idea......and it would get you flying much quicker.
Bob Martin
Yes, I bought one.......but not because of the liability factor.......I just wanted
to fly!!!

I don't think anyone has been successfully sued in the situation you
suggest. RV's are a proven design. They change hands every day. EAA has
info on how to minimize the risk. Check with them .
Life's short. Chase your dream and build it.

9 east of Stantons. Smoothest grass strip ever. Long and wide. 20+ timers
hang out there all the time. Big barn philled (get it?) with tractors and
aircraft. Our own Delta-Delta gave it the name "Phil's aerospace and
tractor museum" a couple summers ago. Low pass required before landing.
Good times.....

If you expect to last at least 18 years after it's registered, current
law says your liability as manufacturer will end there. If you crash &
damage something or someone in the meantime, you or your estate still
can be sued, but the same applies to driving a car. (FWIW, the
likelihood of hurting another person, other than a passenger in your
plane, is pretty remote unless you have a ramp incident.)
If your estate can afford to take the financial hit, you/she can scrap
the plane or donate it to a museum with provision that it never be flown.

Bob,
You only live once (for certain {:>)). If you ever had a dream of
building/flying your own aircraft, I would say go for it. See a Lawyer and
put your assets in an appropriate trust (remove it from your estate) for
your potential widow. Then build and fly your aircraft. I waited until I
was 59 and only wish I had done it 33 years sooner when I first had the
itch.
That my take on it. Be prudent, but DON'T let the lawyers or threats of
lawsuits (none of which I am aware have ever been successfully take against
a homebuilder) take your dream.
