that weather radar site were taken out as the storm progressed. Any airline
pilots out there know if ARTCC is working???

That is actually a really good question as I am planning to fly through there
on Sunday.
BTW, I am planning to fly from Sacramento to Ft. Lauderdale and back again,
leaving this weekend. Anyone want to go along just for the hell of it? I need
to put my boat back in the water and get the rest of my stuff to finish my
move back to California. If anyone has a morbid curiosity I will be overflying
the area hit hardest by Katrina.

Ahhh, the perfect follow-up to the TFR thread. Interesting flight since there is
a huge TFR over the area. OTOH, radar is out for low altitude airways so maybe
they won't see you.

I suspect they are going to be notably trigger happy and, contrary to popular
belief, I am *NOT* stupid. You know, sometimes discretion is the better part
of valor. I would never knowingly violate an FAR anyway.
I already figured there would be a TFR there.
Oh f---, our fearless leader is going to "demonstrate leadership" and hose up
a bunch of airspace there tomorrow. Here's hoping he will be gone by Sunday
when I have to blow through.
It could be interesting, mostly for being able to find fuel along the way. I
should be able to make it from east TX to the FL panhandle without too much
trouble tho'.

looting and shooting people.
Sadly, this is pretty bad. The veneer of civilization is pretty thin in some
parts of the world. I would not have expected that of people in the US.
I know that several RPA members are members of various flying aid
organizations. Any of you planning to help with the mounting aid operation? If
you are and know anyone who needs a flying pick-up truck, I was planning to
fly through there and will have the seats out of the plane so I can carry lots
of stuff anyway. No reason not to stop and help out if I can. All I need is
for someone to give me gas. I have a 1500 lb useful load. I can carry a lot of
stuff and get in and out of a 1700' cleared piece of ground.

Hi Craig,
In a spirit of friendliness I submit that the better place to express
your vast aeronautical knowledge and keen wit is not the internet but in
the cockpit BEFORE becoming entangled in a humiliating and demeaning FAA
enforcement violation . That way you don't have to be concerned with
being humble and protecting your arse from the hot seat.
I have re- read your account of events leading up to the FAA's
airspace violation charge against you. Consider, if you will, the
following statements from your account:
1) "... I had to remind them not to LET ME FLY INTO THE NO-FLY
ZONE"
2) "There is no good solution".
First, There have always been STRONG Captains; there have always
been some WEAK Captains. This applies to all PICs. The strong ones do not
have a mindset that CONTROLLERS , Chief Pilots, Vice Presidents or even
FAA administrators are in charge of their cockpits. The STRONG Captains
are not wired to the default position of surrendering Captain's
Authority to some long haired, faceless entity in your headset who is not
there to LET YOU do any specific act.Nor does he hold any attachment to
your throttles or flight controls. Neither does his name or job
description appear in FAR part 91.3, which speaks only of the
responsibility and authority of the PIC.
I spent 37 years fighting to protect and preserve
Captain's Authority for you and others coming along, to inherit. If YOU
surrender it with your humility and contrition along with a reluctance to
USE your authority when faced with the need to do so, then, you deserve
to face an enforcement hearing with your head hung low and your mouth
shut. Think about what others before you have done to protect that mantle
of Captain's Authority which you have inherited. You owe no less a duty
to preserve and protect it for the benefit of those who come after you.
Second, So, what can you do about it? You say, "There is no good
solution". I say there is a hell of a good solution if you stop sleep
walking through your career. Here's what you say the next time some
controller wants to steer your airplane into restricted airspace or
into a dangerous weather condition (eg, hail) - either of which poses a
serious threat to the safety of your aluminum corporation and its
occupants: "The heading you're offering me is not acceptable for safety
reasons; NO DISCUSSION, give me a heading of xxx degrees or ,
alternatively, xxx degrees
immediately, or I'll squawk 7700; I AM EXERCISING EMERGENCY AUTHORITY.".
You'll be amazed at the effectiveness of this phrase and of your
regulatory authority . That's what it's there for. If you have to write a
letter, you simply include the phrase, " could not guarantee the
continued safety of the aircraft and passengers therein in light of the
perceived threat and information available to me at that time- were I to
continue on the course offered by the controller".
Remember, from a legal standpoint the Captain or PIC is in that
position to guarantee the safety and success of the flight. He is the
FINAL and ULTIMATE authority as to that operation. THEREFORE:
Third, In the case of a PART 135 or 121 operator, these are
considered to be COMMON CARRIERS OF PASSENGERS FOR HIRE. Thus, the legal
STANDARD OF CARE to which both the carrier and the employee Captain
(who is also a federal licensee) are held is THE HIGHEST STANDARD OF CARE
ATTAINABLE. Not ORDINARY CARE, as in the case of a PART 91 operator.
Throughout the law the only instance where this elevated standard of care
is required is in the operation of a common carrier of passengers for
hire. THEREFORE, The Captain is held to a higher standard of care in the
performance of his duties than is the entire FAA or any employee thereof.
The Captain is the ultimate guarantor of the safety of the flight and
passengers. If this scares anyone they can tear off one stripe and cut
the wreath off the wings and be a co-pilot. But even the co-pilot is
still an employee of a common carrier, but without the ultimate
resonsibility.
If you're the Captain, act like the Captain, don't make people
guess who's in charge here, and don't let controllers make your
decisions-they all suffer from testicle envy.

Briefing now was not specific but...told me to stay away from "coastal
areas and their TFR's" trust me I'll be getting specific tomorrow

A little off topic here but I have to ask.
Several weeks ago there was a Movie on TV about a Hurricane that hits LA,
disrupts oil and pretty much starts WWIII. I cant remember the name, did
anyone else see it???? What was the name of it.
